Elk County, Pennsylvania is a rural north-central county with Ridgway as its county seat and the City of St. Marys as its largest population center. Its court system operates within the 59th Judicial District and includes a Court of Common Pleas with civil, criminal, and Orphans’ Court divisions, two Magisterial District Courts serving different geographic portions of the county, and several municipal courts. Court records generated within this system — including dockets, judgments, pleadings, orders, decrees, and case calendars — form the documentary foundation of legal proceedings and are maintained by separate county offices depending on the type of case.
Individuals researching Pennsylvania court cases can access publicly available records through the Unified Judicial System of Pennsylvania Web Portal, which covers courts statewide. For county-specific guidance on clerks, locations, and local procedures, PennsylvaniaCourts.us can help orient users toward available tools and official resources. Records may also be located in person at the courthouse, through mail requests to the appropriate county office, or via public access terminals maintained by the county.

Are Court Records Public in Elk County?
Pennsylvania court records are generally public under the Pennsylvania Right-to-Know Law (RTKL), which took effect in 2009 and broadly establishes that records held by government agencies are presumed public unless a specific exemption applies. For court financial records, the Supreme Court of Pennsylvania’s Rule 509 of the Rules of Judicial Administration provides a systematic process for requesting court records related to the use of public funds.
Open records requests for most county government records must be submitted using either the county’s request form or the form available through the Pennsylvania Office of Open Records. Elk County does not accept anonymous requests under 65 P.S. § 67.1101(a)(1). The Open Records Officer is located at the Courthouse Annex:

Elk County Criminal Court Records
The Elk County Court of Common Pleas handles criminal felony matters after cases are bound over from the Magisterial District Courts. The Clerk of Courts — held by the same officer as the Prothonotary — manages all criminal case files at the Common Pleas level, including charging documents, court orders, plea records, and sentencing dispositions.
For criminal cases still at the magisterial level — typically summary offenses and misdemeanor preliminary proceedings — records are held by the appropriate Magisterial District Court:
Magisterial District Court 59-3-02

Sheriff’s Office — arrest records and warrant information:
The Elk County Sheriff’s Office is the primary law enforcement custodian for arrest-related records and active warrants. The featured warrants page on the county website lists individuals currently sought by the Sheriff’s Office.
Elk County Sheriff’s Office
Address: 250 Main Street, P.O. Box 336, Ridgway, PA 15853

Fax: (814) 776-5396
Email: sheriff1@countyofelkpa.gov
Hours: Monday–Friday, 8:30 a.m.–4:00 p.m. (excluding holidays)
Law enforcement records held by the Sheriff’s Office are governed separately from court records under the RTKL and applicable criminal justice statutes. Requests should be submitted in writing to the Sheriff’s Office directly. Active criminal cases pending court disposition may require requesters to be directed to the District Attorney’s Office for discovery-related materials.
Elk County Civil Court Records
Civil cases in Elk County — including contract disputes, personal injury actions, mechanics liens, judgments, appeals from Magisterial District Judges, and equity matters — are filed with and maintained by the Prothonotary’s Office at the Court of Common Pleas. The Prothonotary also processes protection from abuse (PFA) petitions and mental health commitment records.
The Elk County Prothonotary’s online civil docket system provides remote access to civil case records and allows searches by case number, participant name, or participant address. This system is a useful first step before submitting a formal records request.
For copies of civil case documents, requesters may:
- Visit the Prothonotary’s office in person at 250 Main Street, Suite 114 during business hours (8:30 a.m.–4:00 p.m., Monday–Friday).
- Submit a written mail request to P.O. Box 237, Ridgway, PA 15853, with details of the case and the specific document sought.
- Search and view docket sheets online through the UJS Portal.
The fee schedule established under Rule 509 applies to civil court records: copies cost $0.25 per page, with retrieval and redaction billed at $5.00 per 15-minute increment and postage charged at actual cost.
The fee schedules page on the county website provides the current civil and criminal filing fee schedules applicable to the Prothonotary and Clerk of Courts offices. Note that updated fee schedules took effect in December 2025, so requesters should verify current rates before filing.
Property records such as deeds, mortgages, and liens are maintained by the Elk County Recorder of Deeds, which is co-located in the courthouse complex at 250 Main Street. The Recorder’s office is open Monday–Friday, 8:30 a.m.–4:00 p.m., and accepts in-person and mail requests. New fee schedules also took effect for the Recorder’s Office on December 1, 2025.

Domestic relations matters — including divorce, child custody, child support, and protection from abuse — are handled by the Court of Common Pleas, with records maintained by the Prothonotary’s Office. Divorce records filed in Elk County can also be located through the UJS Case Search portal.
Marriage licenses are issued and maintained by the Clerk of the Orphans’ Court, which is part of the same office that handles the Register of Wills and Recorder of Deeds functions. Elk County’s marriage records date back to October 1885. All requests must go to:

Address: 250 Main Street, P.O. Box 314, Ridgway, PA 15853

Email: recorder@countyofelkpa.gov

If the marriage license was issued in a different Pennsylvania county, contact that county’s Clerk of Orphans’ Court, as licenses are issued county-by-county regardless of where the ceremony was performed.
Birth and death records are handled differently depending on the year involved. The Register and Recorder’s Office holds birth and death records for most events occurring between 1893 and 1906, which can be viewed on public terminals in the office. For events after 1906, certified copies must be requested from the Pennsylvania Department of Health, Division of Vital Records:
Pennsylvania Department of Health — Division of Vital Records

Phone: (724) 656-3100
Toll-free: (844) 228-3516
Birth certificates cost $20.00 each. Death certificates are also $20.00 per copy. Both types of records are restricted — birth certificates are available only to the individual named (age 18 or older), parents, legal guardians, spouse, siblings, grandparents, children, grandchildren, and authorized legal representatives. Death certificates are limited to immediate family members, legal representatives, and individuals with a direct legal or financial interest.
Elk County Probate Court Records
Probate matters in Elk County are handled by the Orphans’ Court division of the Court of Common Pleas. The same county office — the Register of Wills, Recorder of Deeds, and Clerk of Orphans’ Court — serves as the administrative hub for probate proceedings, with Lee A. Neureiter currently holding all three elected positions.
Jurisdiction of the Orphans’ Court includes:
- Decedent’s estate administration (with and without a will)
- Probate of wills and appointment of executors or administrators
- Guardianships for minors and incapacitated adults
- Conservatorships
- Trust administration
- Adoption proceedings
- Small estate matters
- Wrongful death cases
The Register of Wills acts as an agent of the Commonwealth for the collection of Inheritance Taxes, which are then disbursed to the Pennsylvania Department of Revenue. When an estate is opened, the Register swears in the Executor or Administrator and oversees the documentation of the estate’s legal and financial aspects. In situations where a formal estate does not need to be opened, the Register can issue the appropriate paperwork to facilitate distribution of the decedent’s assets.
Probate case records are generally public, with the exception of sealed or restricted matters. They can be searched through the UJS Case Search portal or by contacting the Orphans’ Court clerk directly. For in-person visits or written requests, use the courthouse address at 250 Main Street, P.O. Box 314, Ridgway, PA 15853. Calling ahead is advisable to confirm document availability and applicable copy fees before visiting.
Court forms for common probate filings — including estate and guardianship documents — are available through the 59th Judicial District court forms page. The guardianships section of the county website provides additional procedural information for those initiating guardianship proceedings. Staff at the Register’s office are not permitted to provide legal advice; individuals with complex estate questions are encouraged to consult a licensed attorney.
