In-person access: Each office allows walk-in visitors to inspect non-confidential records during regular business hours. Staff can retrieve documents and provide certified copies upon payment of the applicable fee.

Mail requests: Written requests should be addressed to the specific office holding the record, include as much identifying information as possible (party names, docket number, approximate filing date), and be accompanied by a check or money order payable to the office for the estimated fees. Are Court Records Public in Montgomery County?

Pennsylvania provides two overlapping frameworks that govern public access to court records. The Pennsylvania Right-to-Know Law broadly establishes a presumption of public access to government records, while the Case Records Public Access Policy of the Unified Judicial System specifically addresses judicial records and defines what may and may not be disclosed.

Under the Case Records Public Access Policy, docket sheets and most filings in criminal and civil cases are open to inspection by any member of the public, either in person at the custodial office or through the UJS Portal. However, certain categories of information are restricted:

  • Confidential personal identifiers — Social Security numbers, financial account numbers, driver’s license numbers, and dates of birth of minors must be filed on a separate Confidential Information Form and are not included in the public docket.
  • Juvenile records — Proceedings involving minors in delinquency and dependency matters are confidential.
  • Adoption records — Sealed upon finalization; access requires a court order.
  • Medical and mental health records — Protected under both state and federal law.
  • Grand jury materials — Impounded and accessible only by court order.
  • Sealed criminal records — Cases expunged or sealed by statute or court order may not be disclosed.
  • Jury information — Names, addresses, and other identifying data of jurors are confidential.

Montgomery County’s Prothonotary has published a local Public Access Policy that mirrors the statewide framework and requires filers to use the Confidential Information Form to safeguard sensitive data. Searching criminal records online:

Pennsylvania Access to Criminal History (PATCH): For a formal statewide criminal background check, use the PATCH system maintained by the Pennsylvania State Police. The fee is $22.00, payable online by credit card (a 2% processing surcharge applies to online credit-card transactions as of April 22, 2026). Mail-in requests paying by check are not subject to the surcharge. PATCH results reflect the state criminal history repository and should not be confused with docket-sheet data, which does not constitute an official background check. Incarceration records: The Pennsylvania Department of Corrections maintains an Inmate/Parolee Locator for individuals sentenced to state correctional institutions. County-level detention records are held by the Montgomery County Correctional Facility.

Records that have been expunged by court order or sealed under Pennsylvania law are not available through any public search tool. Petitions for expungement must be filed with the Clerk of Courts by mail or in person, as PACFile does not currently accept electronic expungement filings.

Montgomery County Civil Court Records

The Prothonotary accepts filings electronically through the statewide e-filing system, by mail (P.O. Box 311, Norristown, PA 19404-0311), or via a drop box located in the Norristown Courthouse lobby. Copy fees: The Prothonotary charges $0.50 for the first page and $0.10 for each additional page for uncertified copies. Certified copies and other filing fees follow the county’s published schedule. The Recorder of Deeds maintains a separate Public Access System for land records—deeds, mortgages, liens, and UCC filings—which can be searched online by name, document type, or recording date.

Montgomery County Family Court Records

Family law matters in Montgomery County are divided between two offices. The Court of Common Pleas handles divorce, custody, equitable distribution, Protection From Abuse petitions, adoption, and related proceedings through the Prothonotary (for filings) and the judiciary. Child support, spousal support, and alimony pendente lite matters involving an active PACSES case are processed by the Domestic Relations Section, not the Prothonotary.

Birth and death records: The Register of Wills holds birth records for persons born in Montgomery County between 1893 and 1915. Records for births after 1915 are maintained by the Pennsylvania Division of Vital Records under the Department of Health. In Pennsylvania, birth records become publicly accessible after 105 years and death records after 50 years. Eligible individuals may request copies directly from the Division of Vital Records or from the county Register of Wills Office for records within its custody.

Confidentiality considerations: Juvenile dependency and delinquency proceedings are confidential. Adoption records are sealed upon finalization. Protection From Abuse case details may include restricted information about victims. Support-related financial records maintained by the Domestic Relations Section are not available to the general public.

Montgomery County Probate Court Records

Probate jurisdiction in Montgomery County belongs to the Orphans’ Court Division of the Court of Common Pleas. The Register of Wills and Clerk of Orphans’ Court administers the filing and record-keeping functions for all estate and trust matters.

The office handles probate of wills, grants letters testamentary and letters of administration for intestate estates, receives accountings by executors and administrators, issues short certificates for asset transfers, and serves as the Commonwealth’s agent for inheritance-tax collection, processing more than $200 million annually.

Fees: The Register of Wills publishes separate fee schedules for the Register of Wills and the Orphans’ Court, both effective January 1, 2026. As of December 1, 2025, the Judicial Computer Project Fee increased from $40.25 to $41.25, which is added to many filing fees. Probate filing costs vary by estate size and proceeding type; the published PDF schedules contain itemized amounts for each category.

Most probate records are public and can be inspected at the Register of Wills office or searched online. Wills become public documents once admitted to probate. Wills that have been deposited for safekeeping but not yet submitted for probate are not part of the public record. Adoption records processed through the Orphans’ Court are sealed, and mental health commitment records are confidential under Pennsylvania law.
