Are Court Records Public in Westmoreland County?

Statewide Criminal Background Checks

The Pennsylvania State Police operate the Pennsylvania Access to Criminal History (PATCH) system, which provides name-based criminal history checks. As of April 2026, the fee is $22.00 per record check, with an additional 2% credit card transaction fee for online submissions. To use PATCH, submit a new record check request, accept the terms and conditions, select “Individual Request”, and provide the required identifying information.

Restricted Criminal Records

Public access is prohibited for criminal records involving juveniles, sealed or expunged cases, active law enforcement investigations, witness and victim identifying details, and undercover law enforcement information.

Westmoreland County Civil Court Records

Magisterial District Courts

Small claims, landlord-tenant disputes, and certain civil matters under the monetary threshold are heard in the county’s Magisterial District Courts. A list of Magisterial District Judges is maintained by the Unified Judicial System. Several Magisterial District Courts serve Westmoreland County, with locations in Greensburg, Jeannette, New Kensington, Latrobe, North Huntingdon, Export, Apollo, Ligonier, Mount Pleasant, and other communities.

Westmoreland County Family Court Records

Family law proceedings in Westmoreland County — including divorce, child custody, child support, paternity, spousal support, and protection from abuse (PFA) actions — are handled by the Family Division of the Court of Common Pleas. All family filings are processed through the Prothonotary’s Office. Marriage Records

Marriage licenses are issued and maintained by the Register of Wills and Clerk of the Orphans’ Court. Marriage license records from 1885 to the present are available. Records from 1988 forward can be searched online through the Register of Wills online services portal. Users may log in as a guest, access the public records search, and search by party name and marriage date. For older records, an in-person visit to the Register of Wills office is required.

Divorce Records

Divorce records in Westmoreland County are maintained by the Prothonotary’s Office. Records can be searched online through the iJEMS public access website for records up to 2018, or by contacting the Prothonotary at (724) 830-3507 or proijems@westmorelandcountypa.gov. In-person requests can be made at Suite 501 of the courthouse during regular hours.

Birth and Death Records

The Register of Wills maintains a limited collection of Westmoreland County birth records from 1893 to 1905 and an incomplete set of birth, death, and marriage records from 1852 to 1855. For records after 1905, requests must be directed to the Pennsylvania Department of Health, Division of Vital Records. Certificates can be ordered through the online ordering portal or by completing and mailing an application for a birth certificate or death certificate.

Online orders cost $30.00 per certificate. Mail-in orders cost $20.00 per certificate and should include a completed application, a copy of valid identification, and a check or money order. Birth certificates in Pennsylvania are restricted to the individual named on the record, family members, legal representatives, and those with a court order. Birth records become public 105 years after the date of birth, and death records become public 50 years after the date of death.

Westmoreland County Probate Court Records

Probate matters in Westmoreland County are handled by the Orphans’ Court division of the Court of Common Pleas. The Register of Wills and Clerk of Orphans’ Court serves as the filing and docketing office for all Orphans’ Court matters. The office manages the probating of wills, the issuance of letters testamentary and letters of administration, estate administration records, guardianship proceedings, adoption filings, and termination of parental rights cases. Estate records date back to 1773, and Orphans’ Court records are available from 1750 to the present.

Searching Probate Records

Estate records from 1986 to the present can be searched online through the Register of Wills online services portal. After creating a free account or logging in as a guest, users can access public records search tools and look up estate filings by name. Older records must be examined in person at the Register of Wills office on the third floor of the courthouse. Approved Westmoreland County forms for probate matters, including Petitions for Distribution, Decrees, and Certificates of Award of Real Estate, are available on the Orphans’ Court forms page and at the Register of Wills office.

Estate cases are assigned to a judge when the first issue is raised. Audit schedules and deadlines for filing first and final accounts are published in the Westmoreland Law Journal and on the county’s audit schedule page. Attorneys must present proposed petitions and decrees to the Orphans’ Court administrator for review before the audit date, per Westmoreland County Orphans’ Court Rule WO102(d).

The Register of Wills also serves as the agent for the Pennsylvania Department of Revenue for collection of inheritance tax. Virtual services are available for estate representative swearing-in at a fee of $100.00. Appointments should be scheduled by calling (724) 830-3177.
